Terms of Service

1. What we sell

FreshlyFunded sells lists of business contact data compiled from publicly available funding announcements and other public sources, verified and enriched by our team, and delivered as a downloadable CSV file and/or a recurring weekly email. Plans are one-time payments, not subscriptions, unless a specific plan states otherwise on the pricing page at the time of purchase.

Where a plan includes weekly leads “for life” or “forever,” that means for the lifetime of the FreshlyFunded weekly list: we will keep sending it for as long as we publish it. It does not mean the lifetime of the buyer or of the buyer’s company.

2. Orders and payment

Orders are sold and processed by Pocketsflow, Inc. (“Pocketsflow”), which acts as the Merchant of Record for your purchase. Pocketsflow handles payment collection, applicable sales tax/VAT, receipts and payment-related customer service, and its buyer terms also apply to the payment itself. Prices are set in US dollars; your checkout may show an approximate amount in your local currency. Orders are payable in full at the time of purchase.

3. Acceptable use

You agree to use any data you receive from us only for lawful purposes, including:

• Complying with applicable anti-spam, data protection and privacy laws (including CAN-SPAM, GDPR and UK GDPR where relevant) when contacting individuals in the data.
• Not reselling, republishing or redistributing the raw data as a standalone product or competing dataset.
• Not using the data to harass, defraud or deceive any person or organization.

We may suspend or terminate access to the Service for any account we reasonably believe is violating these Terms.

4. Accuracy of data

We verify contact records by hand before delivery, but contact details, company information and funding data can change or become outdated after delivery. Data is provided “as is” and we do not guarantee a specific reply rate, deliverability rate or business outcome from using it.

5. Refunds

Refund eligibility is described in our Refund Policy, which forms part of these Terms.

6. Intellectual property

The FreshlyFunded website, branding and compilation of data into our specific format are our property or licensed to us. Purchasing a list grants you a non-exclusive license to use the data internally for your own outreach and sales purposes; it does not transfer ownership of our compilation, formatting or brand.

7. Limitation of liability

To the maximum extent permitted by law, FreshlyFunded is not liable for indirect, incidental or consequential damages arising from use of the Service or the data provided. Our total liability for any claim is limited to the amount you paid for the order giving rise to the claim.

8. Changes to these Terms

We may update these Terms from time to time. Changes take effect once posted on this page with an updated date. Continued use of the Service after changes are posted means you accept the revised Terms.
